Other times, we concede infringement and argue solely over the likely miniscule award of a reasonable royalty with no finding of willfulness, which would permit an award of enhanced damages. We fight claims of lost profits. We assert federal court declaratory relief actions when appropriate to secure the proper forum for an efficient and cost-effective defense. We counter-claim where appropriate with parallel allegations of infringement or unfair competition.
